REGULATIONS OF THE ONLINE SHOP
TAPIS ATELIER
1. GENERAL PROVISIONS
The online shop TAPIS ATELIER, operating at the address: www.tapisatelier.eu, is run by the company BORUGS Borys Szewczyk, headquartered at ul. Łódzka 14a, Rokiciny-Kolonia, 97-221, operating under NIP: 9820387793, REGON: 522998951.
These Regulations of the Online Shop define the terms and conditions for making purchases in the TAPIS ATELIER online shop, in particular the rules and procedure for concluding distance contracts through the Shop, as well as the procedure for complaints and the right for the Consumer to withdraw from the agreement.
In relation to services provided by electronic means, these Regulations constitute the regulations referred to in Article 9 of the Act on the Provision of Electronic Services of 18 July 2002 (Journal of Laws of 2020, item 344, as amended).
The Regulations are addressed to all Customers of the Shop. All Customers are obliged to familiarize themselves with the provisions of the Regulations prior to making a purchase.
Every Customer is required to comply with the provisions of the Regulations. Sales are conducted on the basis of the version of the Regulations in force at the time the order is placed.
Every Customer may familiarize themselves with the Regulations at any time by clicking on the “Regulamin Sklepu” (Shop Regulations) hyperlink on the Shop’s website. The Regulations can be downloaded and printed at any time.
All information on the Shop’s website referring to products (including prices) does not constitute an offer within the meaning of Article 66 of the Civil Code of 23 April 1964 (Journal of Laws of 2020, item 1740, as amended), but rather an invitation to enter into a contract under Article 71 of the Civil Code. By sending the Order Form, the Customer makes an offer to purchase the specified Product at the price and under the terms described.
2. DEFINITIONS
Regulations – these set of rules organising the terms of use of the Shop’s services by Customers.
Consumer (contracts concluded before 1 January 2021) – a natural person entering into a civil law contract via the Shop, not directly related to their business or professional activity.
Consumer (contracts concluded from 1 January 2021) – this refers to:
a natural person entering into a civil law contract via the Shop, not directly related to their business or professional activity (“Consumer sensu stricto”);
a natural person entering into a contract via the Shop, related to their business activity, where from the contract it follows that it does not have a professional character for that person (particularly from business registry data) – the so-called “Entrepreneur with Consumer Rights”.
If it is not distinguished, the Regulations apply to both Consumers sensu stricto and Entrepreneurs with Consumer Rights.
Customer – a natural person (including a Consumer) who is at least 13 years old (with guardian consent), a legal person, or an organisational unit with legal capacity, using the Shop’s services.
Order Form – service available on the Shop’s website, allowing the Customer to buy by adding Products to the Cart and specifying delivery and payment terms.
Cart – the part of the Shop where selected Products are visible and where the Customer can modify order data including quantities.
Shop – the website owned by the Seller at www.tapisatelier.pl, through which the Customer buys Products from the Seller.
Seller – BORUGS Borys Szewczyk, headquartered at ul. Łódzka 14a, Rokiciny-Kolonia, 97-221, NIP: 9820387793, REGON: 522998951, offering Products via the website.
Product – a movable item that is the subject of trade between the Shop and the Customer, as defined in the Order Form.
Sales Agreement – distance sales agreement concluded via the Shop through the Order Form.
3. ACCEPTANCE AND PROCESSING OF ORDERS
The condition for using the Shop is familiarity with and acceptance of these Regulations. By placing an order, the Customer accepts the Regulations.
Orders are accepted via the Order Form on the site or via email at stworzdywan@tapisatelier.pl, 7 days a week, 24/7.
To place an order: select Products, click “ADD TO CART” near product descriptions, then in the Cart fill out the Order Form, choose delivery/payment method (e.g., cash on delivery if available), and confirm purchase.
Entrepreneurs with Consumer Rights (contracts after 1 January 2021) must indicate at the time of ordering that the purchase is not professional.
After placing an order, the Customer receives an order confirmation by email (address given in Order Form).
After receiving acceptance from the Seller, the fulfillment process begins:
a. Cash on delivery orders start at the latest the next business day after seller confirmation.
b. Traditional bank transfer orders begin after the payment is credited to the Shop’s bank account.
Orders are processed on business days (Mon–Fri, 8:00–16:00). Orders placed after 16:00 on a business day, or on weekends/holidays, are processed the next business day.
The Customer receives acceptance of the order, which constitutes the conclusion of the Sales Agreement.
A VAT receipt is issued for each order; a VAT invoice is provided upon request.

The price given in the order is final (gross), including tax and delivery.
The Seller reserves the right to change prices, introduce/remove Products, and run or cancel promotions in compliance with law.
If additional costs apply beyond the agreed price, the Shop promptly informs the Consumer, explaining the cause; such costs are charged only with clear Consumer consent.
4. DELIVERY AND TRANSPORT COSTS
Orders are delivered via:
parcel lockers
courier service
Orders are processed only on business days; weekend/holiday orders are processed the next business day.
Regular delivery time is 3 business days, which includes order fulfillment and delivery (~24 h within Poland).
The Seller is not responsible for courier delays.
Upon courier delivery, the Customer should inspect the package in courier presence; if damaged, a damage report must be drawn up in two identical copies signed by both parties.
Self-pickup is possible at the Shop’s physical location (contact via kontakt@tapisatelier.pl).
5. PAYMENT METHODS
Accepted payment methods:
Traditional bank transfer
Klarna
- Card payments
For bank transfer, payment must be made within 5 business days of ordering; otherwise, the order is cancelled. In the payment title, only the order number is needed. Payment extension is possible upon prior notice.
6. COMPLAINTS
The Seller is liable under warranty for physical and legal defects as per Article 556 et seq. of the Civil Code.
A physical defect is when the Product:
lacks expected properties
fails to meet Seller’s assurances
isn’t fit for the intended purpose
is incomplete
A legal defect arises if a third party owns the Product or restricts its use.
In case of Contractors (as Consumer), public claims by the manufacturer are treated equally unless the Seller did not know or could not know them, or they were corrected before the sale.
The Seller is liable for defects if discovered within 2 years from delivery.
If a defect is discovered within 1 year, it is presumed to have existed at delivery.
If defective, the Customer may request a price reduction or withdrawal unless the Seller replaces or repairs promptly.
The Customer may demand replacement or repair of the Product.
The Consumer may choose replacement over repair, unless it’s impossible or excessively costly.
The Customer cannot withdraw if the defect is minor.
Complaints can be made:
a. In writing to the Seller’s address
b. By email (address given in order confirmation)
A complaint should include:
a. Customer’s personal data (name, address, optional email/phone)
b. Reason and request
c. Order number
d. Proof of purchase (optional)
The defective Product should be returned at the Seller’s cost to kontakt@tapisatelier.pl.
The Seller responds within 14 days.
If justified, the Seller replaces or repairs within 14 days of complaint submission.
In case of effective withdrawal, the Seller refunds payment within 14 days, after receiving Product or proof of return.
If the Seller does not respond to a justified claim within 14 days, it is accepted as justified.
Claims expire after 1 year from defect discovery; for Consumers, the expiry cannot be less than 2 years.
These provisions do not exclude separate warranty terms.
7. RIGHT OF WITHDRAWAL
Under the Consumer Rights Act of 30 May 2014 (Journal of Laws 2020, item 287, as amended), a Consumer may withdraw from a purchase order within 14 days of delivery without giving a reason. Sending the statement before the deadline is sufficient.
Withdrawal must be sent to kontakt@tapisatelier.pl; a template is provided as Annex 1.
The Product must be returned within 14 days from the withdrawal date to:

The Seller refunds all payments including delivery costs within 14 days of receipt of withdrawal, but only after receiving the Product or proof of return.
Refund is made via the same payment method used.
The Consumer bears the return costs.
Right of withdrawal does not apply to:
customized or non-prefabricated items produced per Consumer’s specifications
perishable or rapidly deteriorating items
sealed items that cannot be returned after opening for hygiene or health reasons
items irreversibly connected to others after delivery
sealed audio, visual media, or software where seal is broken
newspapers or periodicals (except subscriptions)
services whose price depends on financial market fluctuations not controlled by the entrepreneur
digital content not on a material medium if performance began with Consumer’s consent and after being informed about loss of withdrawal right
The right of withdrawal does not apply to entities other than Consumers under the Regulations’ definition.
8. OUT-OF-COURT DISPUTE RESOLUTION
If a complaint outcome is unsatisfactory, the Consumer may use:
Mediation by the appropriate Voivodeship Trade Inspection
Permanent Consumer Arbitration Court at the Trade Inspection
Free assistance of city or district consumer ombudsman
The ODR (Online Dispute Resolution) platform
This section does not apply to “Entrepreneurs with Consumer Rights” (post-2021 contracts).
9. PERSONAL DATA PROTECTION
By placing an order, the Customer consents to processing of their personal data for order fulfillment by the Seller, the data controller under GDPR (EU Regulation 2016/679).
Customer data is not shared with entities not involved in order fulfillment.
The Customer has right to access, correct, or delete their data under GDPR.
Providing data is voluntary but required to complete the order.
Detailed privacy information is in the “Privacy Policy” section of the Shop.
10. FINAL PROVISIONS
The Regulations define the terms of conclusion and performance of Sales Agreements.
The Sales Agreement is concluded between the Customer and the Seller.
The Regulations are available electronically on the Shop’s website.
Using the Shop requires an internet-enabled device, browser, and provision of an email address.
Posting unlawful content on the Shop’s site is prohibited.
Polish law applies where the Regulations do not.
The Regulations do not limit any rights of the Consumer granted by mandatory legal provisions.
If any provision is invalid or unenforceable, the rest remains in effect; invalid provisions will be replaced to reflect the intended economic purpose.
